Bureau of Prisons
The Bureau of Prisons (BoP), is the United States (US) Department of Justice agency that administers the federal prison system. More than 121 correctional facilities, six regional offices, two training centers, and 22 corrections offices comprise the BoP, which confined 206,307 federal offenders as of September 2015, approximately 81 percent in BoP facilities, the rest with state and local governments or private corrections and detention centers, and prisons. The BoP has exclusive jurisdiction over inmates in its custody. Inmate Types – What type of Inmates are incarcerated in federal prisons
The BoP confines inmates convicted of federal law violations and ordered into pre-trial detention for the US Marshals Service and Immigration and Customs Enforcement. The BoP also confines individuals convicted of felony offenses under District of Columbia law.
Federal Bureau of Prisons Security Levels
The BoP has five institutional security levels:
- BoP minimum security facilities with little or no enclosure and a low numerical ratio of officers to inmates.
- Low-security federal correctional institutions with perimeter fences and mostly partitioned dormitory inmate housing.
- Medium-security federal correctional institutions with doubly-fenced perimeters, electronic detection systems, and mostly cell housing.
- US penitentiaries, high-security facilities with walls and watch towers.
- Federal correctional complexes, BoP colocation facilities with various security levels.
The BoP contracts with correction facilities that confine juvenile offenders. Under US Code Title 18 Section 5039 the BoP may not confine a juvenile in an adult correctional institution with regular contact with adults convicted of or detained pretrial on criminal charges. Juveniles sentenced as adults move into adult facilities at age 18, those sentenced as juveniles at age 21.
Imprisonment Laws
BoP regulations are in Code of Federal Regulations Title 28 Sections 500 et sequiter (28 CFR 500 et seq).
Regulation of contacts with persons in the community is under 28 CFR 540. Regulation of inmate discipline is under 28 CFR 541. Administrative remedy regulations for any issue of inmate confinement are under 28 CFR 542. Regulations on penal labor are under 28 CFR 545. Provisions for “special administrative measures” are under 28 CFR 501.3.
The BoP Inmate Admission & Orientation Handbook provides new arrivals with information about the BoP, its programs, and rules and regulations. The handbook helps inmates understand what they encounter when they enter prison and assists them in their adjustment to incarceration. The handbook lists and explains 11 enumerated general “Inmate Rights and Responsibilities” and 15 enumerated “Health Services Rights and Responsibilities” under those headings.
Inmate Rights
Federal and state laws govern the rights of BoP inmates. Inmates do not have full constitutional rights but are protected by the 8th Amendment prohibition of cruel and unusual punishment requiring a minimum standard of living. Prisoners retain the right to due process in administrative remedies and appeals. The Equal Protection Clause of the 14th Amendment applies to prison inmates as protection from disparate treatment for gender, race, or religion. Inmates have limited rights to freedom of speech and religion under the 1st Amendment.
Congress has given the BoP full discretion to control prisoner classification for conditions of confinement. So long as the conditions of a prisoner’s incarceration are within the sentence and not otherwise unconstitutional, due process requires no judicial oversight.
Commissary for Federal Bureau of prisons
A BoP commissary is a store within a correctional facility where inmates may purchase merchandise. The BoP does not permit inmates to possess cash; instead, they make purchases through a commissary account with funds from money earned as wages or contributed by family and friends. Regulation of inmate commissary accounts is under 28 CFR 506, which “allow[s] the [BoP] to maintain inmates’ monies while they are incarcerated,” 28 CFR 506.1.
“[To] deposit funds into an inmate commissary account [f]amily and friends must mail deposits to the centralized inmate commissary account . . . The deposit envelope must not contain any enclosures intended for delivery to the inmate . . . [and] [t]he deposit must be in the form of a money order made out to the inmate’s full name and complete register number,” 28 CFR 506.2.
Visitation – Inmates visitation policies and rules in Federal prisons
BoP visiting regulations are at 28 CFR 540.40–540.52. Visitors must be on the inmate’s visiting list and cleared by BoP for visits. Inmates create their visiting lists by means of an established process:
- Inmates receive visitor information form on arrival at BoP facilities.
- They complete their portions of the forms and mail a copy to each potential visitor.
- Potential visitors complete all remaining form information and return/send the completed forms to the inmate’s address listed on the form.
- The BoP investigates by requesting more background information or contacting other law enforcement agencies.
- The BoP notifies the inmate when disapproving potential visitors and the inmate is responsible for notifying them of the disapproval.
Even if approved, visitors should contact the BoP facility in advance to be sure their visits will proceed as scheduled. Visitors should be familiar with all visiting rules, regulations, and procedures. They should dress appropriately for large gatherings of men, women, and young children. Inappropriate clothing may be a reason to deny visitation.
By law, 28 CFR 540.43, an inmate has at least four hours of visiting time per month but usually the prison can allow more. The warden may restrict or limit the frequency or duration of visits or the number of visitors at one time. Visits should be quiet, orderly, and dignified. Handshakes, hugs, and embraces are permissible only at the beginning and the end of a visit. Officers may limit contacts to maintain security and to keep order. The BoP does not permit conjugal visits.
All BoP facilities schedule visiting hours on weekends and holidays, and most schedule them at other times during the week. Factors that may affect the days and times for visits are prison location, prison type, inmate visiting needs, and availability of visiting space. Again, visitors do well to contact the BoP facility in advance to confirm visitation arrangements.
Paroles
Conditionally released from incarceration, parolees remain under their sentences and may return to prison if they violate any conditions of their paroles. Procedures for revocation of parole are under 28 CFR 572.30–31. A specific type of parole may be on medical or humanitarian grounds. Typical conditions of parole are to refrain from drug use, avoid contact with criminals, maintain employment, and report regularly to a parole officer.
The Sentencing Reform Act of 1984, US Code Title 18 Section 3551, which became law on 1 November 1987, makes no provision for parole. The only good conduct time available is 54 days for each year of the sentence, none for life terms or for sentences of one year or less. The BoP awards good conduct time in part or in whole after the end of each year served on the sentence. Once awarded, good conduct time is vests and may not be forfeited at a later time.
Bails
Under the 8th Amendment the BoP must not require “excessive bail” from inmates in pretrial detention.
Inmate Services in Federal prisons
The BoP provides progressive and humane treatment and services to inmates with education, medical care, mental health, religious, sexual abuse prevention, substance abuse treatment, social reentry, and work training programs that promote and support their successful reintegration into civil society.
